Terms & Conditions

The following terms and conditions apply to all users (hereafter also known as “Users”) of WAUG Singapore Pte. Ltd. (“WAUG”, “we”, “us”, “our”)’s website, applications, mobile site and other distribution channels (collectively, “Platforms”). Visitors of our Platforms ("User" or "you") may use the Platforms only on the condition that they accept the Terms & Conditions. Any further use of the Platforms or any part of it means you have understood and agree to be bound by all parts of the Terms of Conditions.

 

Rights for Usage

As a condition to using the Platforms, you warrant that you (i) possess the legal authority to create a binding legal obligation, (ii) will use the Platforms by its Terms & Conditions and (iii) all information supplied by you is true, accurate, current and complete. We retain the right, at our sole discretion, to deny access to anyone to the platforms and the services we offer, at any time and for any reasons, including but not limited to this set of Terms & Conditions.

 

Intellectual Property

Users acknowledge that WAUG owns all right, title and interest in all intellectual property rights, including all content, logos, trade names, trademarks and service marks, and any content, data, software, technology, tools or business methods used by WAUG to develop, promote, market, sell, and distribute the Products (collectively the “WAUG Intellectual Property”). Nothing in this Agreement shall be deemed or construed as a transfer of any WAUG Intellectual Property to the Users. Any Intellection Property breach will result in the immediate termination of access to the Platforms. 

 

Scope of Terms

We may update or modify the terms of these Terms & Conditions without prior notice and your continued use of our Platforms after the changed Terms & Conditions take effect, you will be bound by the modified terms. In case you do not agree to all the terms in this Terms & Conditions and/or the changes, you should discontinue using the Platforms.

 

Privacy Policy 

For WAUG’s policy relating to its use of your personal information, please review our current Privacy Policy, which is at this moment incorporated by reference to this Terms & Conditions. Your acceptance of these Terms & Conditions constitutes your acceptance and agreement to be bound by our Privacy Policy.

 

Payment

Full payment is always required at any time of booking unless you have an approved alternative payment arrangement and scheme. All prices and availability of specified booked dates are guaranteed only after WAUG receives full payment. 

WAUG is permitted to collect the invoiced amounts in the name of and on behalf of the Supplier, provided nothing else has been explicitly stated in the Supplier’s invoice. If claims must be paid by the User in a different currency than its national currency (claims for payment in foreign currencies), WAUG can demand payment in the national currency of the user and the foreign currency claim can be converted based on the current exchange rate at the time the contract is concluded. A suitable conversion charge may apply.

To use the payment functions of WAUG, the user must register. The user must enter correct payment information and update the details immediately in the event of changes. WAUG can reject the payment method specified by the user. The user will be notified of the payment methods permitted for the respective service during the order process.

Upon the authorization of the payment, the user consents to his/her payment information being used for the collection of payments by the creditor. WAUG reserves the right to make the use of the payment function of WAUG dependent on a check of the credit rating of the user.

 

Prices

Due to direct connectivity with operators that create a dynamic status, prices may change from the time of inquiry to confirmation. These prices specified by the Suppliers may be subjected to special conditions, for example with regards to cancellation and the refunding of payments made. WAUG reserves the right to correct and/or change the prices without prior written notice.

 

Cancellation Policies

Each product has its own set of cancellation policies as implemented by its operator or provider. All users are advised to check the applicable policies as they can differ by products, dates, and methods of payment. On payment of all bookings, it is deemed that the user has accepted the corresponding set of policies. 

 

Refunds

Products and services in WAUG carry different sets of refund policies based on its cancellation policies. The right to refund can also be limited to changes in travel dates as allowed by respective operators and/or decline of service due to termination of operations. Requests for refunds must be submitted in writing to WAUG no later than ten days after the departure dates via email(support@waug.com).  

All refunds are subject to conditions as outlined under cancellations, changes, and revisions, and are further subject to any handling or administrative fees as imposed by WAUG or its service operators and the third party. 

 

Indemnity of Liabilities

WAUG is a wholesaler, an independent contractor, and an aggregator, which makes arrangements with operators and third-party vendors for all travel products. WAUG is not an agent of the customer or other parties providing travel-related services. All travel documents issued are further subjected to the terms and conditions specified by its vendors.  

Neither WAUG nor any of its appointed agents or employees shall be held liable for, and by accepting these documents, users, their companies and clients waive any claims against all parties for a) any loss of or damage to property or injury to any person caused by reason of a defect, negligence or other wrongful act or omission of or any failure of performance of any kind by any other transportation company, vendor or supplier; b) any inconvenience, loss of enjoyment, mental distress or other similar matter; c) any delayed departure, missed connections, substitutions of accommodations, termination of service or changes in fares and rates; and d) any cancellation or double-booking of reservations, tickets or packages beyond the control of WAUG.  

In no event shall WAUG be responsible for any amount other than the price paid by the User for the tour or package. WAUG reserves the right to accept, decline, retain or remove any person as a member of the tour package program or group at any time.  

Each user agrees that all disputes in any matters whatsoever arising in connection with the responsibility of WAUG under this Terms & Conditions shall be construed and enforced in accordance with the laws of Singapore, and each User consents to the courts in Singapore, being the sole venue of any action related to this agreement, to the exclusion of the courts in any other state or country. Each User waives its rights to a jury trial.  

 

Warranties

While WAUG tries to ensure that the information in or through the Platforms is accurate, it does not provide any warranties, express or implied, about its correctness, completeness, reliability, suitability for any purpose or otherwise (including for any information provided by third- parties). WAUG may change, add or remove information on the Website and its structure and functions at any time at its sole discretion, without specifically informing of any such change, and without removing outdated information or characterizing it as such. WAUG may also block Users from accessing the Platforms or parts of it or requires certain conditions to be fulfilled for such access. WAUG does not provide any warranties, express or implied, about the availability of the Platforms or its functions, that the Platforms are free from defects, or that the Platforms and the infrastructure on which it runs are free from viruses and other harmful software. Moreover, WAUG does not guarantee that information available on the Platforms has not been altered through technical defects or by unauthorized third parties.

 

Right to Refusal and Termination of Contract & Service

WAUG adopts a policy of refusal and/or termination, under appropriate circumstances at its sole discretion. Circumstances include conflict of interest, infringement of data rights, abuse of system data, products & services, features and functions and can include the legal policies of the countries concerned. WAUG may also at its sole discretion limit access to the Platforms and/or terminate the accounts of any Users who infringe any intellectual property rights of others, whether or not there is any repeat infringement. 

 

Responsibilities of Users 

All Accounts and Passwords issued are confidential information and the account must ensure due diligence so that such information is not mishandled or lost. Any breach of this confidentiality would result in the immediate termination of access to the Platforms. If there is a suspected breach of security, all Users must immediately contact WAUG to report their findings or suspicion. 

 
In respect of dispute management, refunds, cancellations, returns, and customer support as they relate to your use of the Platforms, the entity identified below will be the contracting party to these Terms & Conditions  and your first point of contact to mediate or resolve any dispute arising from your use of the Platforms:
